What is Law?

quote:

Biden tells the New York Times he would revoke Section 230 protections and hold Facebook (and other sites) liable for their content.

This is what Trump has suggested today. Lawless people (and politicians) don't care about what they've said before, just what is expedient.

Justice is blind, and it bites. If you want justice, it has to be for me as it is for thee. If you don't care about Justice, then you're merely a lawyer.

Here are the two sides to this issue:

1) Internet social websites are private enterprises and they can do what they like, and let the market judge.

2) These are like malls were people gather, and limiting free speech in such an environment is as intolerable as it is a Constitutional affront.

The first point has been a constitutional imperative of the Right, and second has been a refuge of the Left. SCOTUS has determined the Left always wins in these sorts of issues (lunch counters in the old south for the first, and the aforementioned 'mall cases' in the second).

Social media sites are privately owned business that are ruthless violating the free speech rights of content providers that have spent years developing their business on these platforms. A few that I follow that complain profusely (with reason) are PrayingMedic, TimCast, and Edge of Wonder. I've heard of a lot of others (all on the Right) being periodically banned like James Wood.

How to decide whether social media sites should come under heavier regulatory review?

Tough call.

The last refuge of the Court is anti-trust, a somewhat discarded regulatory doctrine. The Left use to love it, but over the last couple decades it has become an embarrassment after Brown Shoe (the Court said Brown Shoe had too much power, and busted them up. They went broke a few years later because of foreign competition).

So, how should this issue be resolved?

The heavy hand of government is (almost) always wrong, so let's hope the Masters of Silicon Valley buckle under and come up with a fairer solution. They don't have much time.

Biden said that? I imagine he was slipped that script to try to steal Trumps thunder.

Or he misspoke again, and misread a script that told him that Trump said that, and to oppose it.

Either way, Trump should push ahead with this ASAP. They are doing this to us anyway, so I want Don to sic the FEC on them, and take away the pretense that they aren't.

That's a very interesting Reason article, Red. Thanks.

So, I see that old Joe wants to do what Don wants to do - kill section 203.

Convergent political evolution of plans!

One politician wants to coerce the giant companies to do his bidding nad kill opposition adverts.

The other wants to coerce the giant companies to either go back to what Facebook falsely claims to do now, and is pretending to do by defending Dons ad, and to go back to being neautral platforms.

What Zuck the First Cyborg Billionaire is doing is still mostly wrong.

Facebook and Google both warp their News feeds - which are a major source of news in the US - to stack pro-Dem articles high and anti-Dem articles waaaaay back on page "maybe tomorrow."

That and other weird stuff - Google, its pet YouTube, Facebook, and Twitter all need to have whatever protections they have, stripped.

Let the people see them for the biased trash heaps they all are.

Red,

I way over-thunk what Don was doing. He and Biden are on two tracks, not the same one.

Biden wants to remove 203 - Trump wants to leave the first section alone, and modify the second to give us all a sort of "social media bill of rights" in a basic way.

That came clear reading this Reason article:

https://reason.com/volokh/

After reading yours.

This one in in the "Volokh Conspiracy" section.

That guy has been a regular for me for many years. A good, reasonable explainer of legal stuff.

I think that there should be a very high bar that you need to cross to prevent a private company from exercising it's own terms of service however it chooses to. I'm not a constitutional scholar, and I don't know what that bar is. I'm no fan of social media in general, but there are an uncountable number of alternatives to all of them even if there is always going to be one with the highest market share.
